How much does it cost to hire an attorney to help me file my VA claim application?
All initial claims, including a first time filing of an application to increase a disability rating, are free! Federal regulations prohibit attorneys from charging fees for filing VA Disability Compensation applications until an initial decision has been made by the reviewing authority (38 C.F.R. § 14.636(c)). However, attorneys can charge reasonable fees after the initial decision has been made by the reviewing authority or if the attorney is representing the Veteran in any proceeding before a court (38 U.S.C. § 5904). Federal regulations state that attorney fees equal to twenty percent (20%) of the back-pay owed to the Veteran upon approval of the appealed claim are reasonable and will be accepted by the VA (38 C.F.R. § 14.636(h)).
How do I know if I am eligible for VA Pension?
In short, there is no hard-line way to immediately know if you are eligible without considering several factors. VA Pension eligibility consists of a combination of your military service record, age, disability or illness, income, and total asset value. The amount of income and assets you can own and still maintain eligibility changes each year. Our Attorneys can help you determine if you meet the eligibility criteria. What happens if I don’t qualify for VA Pension because of my income or assets?

Absolutely! There are many resources for Veterans and Servicemembers that provide free or low-cost assistance with VA and Non-VA matters! We care about making sure our Veterans and Servicemembers have access to as many resources as are available to them and will do our best to help you find and acquire those resources. If you are interested in finding assistance in your area without the assistance of an attorney, we suggest contacting your county’s Veteran Service Officer (VSO).
