Do I have to have an Estate Plan?
No. In fact, only about 33% of Americans have some form of Estate Plan*. Without an Estate Plan, you have little power to decide what should be done with your property and care in case of emergencies.

What happens if I don’t have an Estate Plan?
Most states [including Indiana] have codified in their Probate Code rules for how a person’s estate is to be distributed if they die without a Will. For Hoosiers, you can find this in Indiana Code Title 29, Article 1, Chapter 2 – “Intestate Succession and Rights of Certain Interested Persons” (Ind. Code § 29-1-2, et seq.).
I don’t have any property. Should I get an Estate Plan?
Estate Plans are plans meant for everyone! Even if you think you don’t have property, Estate Plans can still be very important. Estate Planning is more than just planning for when you pass away. Estate Planning can include a Living Will and Health Care Power of Attorney, so you can have your wishes fulfilled when you may not be able to make a conscious decision.
Additionally, Indiana allows for small estates to be handled without the Probate process, as long as your total estate is less than $100,000. You can find out more in Indiana Code Title 29, Article 1, Chapter 8, Section 1 – “Small estates; payment upon presentation of affidavit; vehicle or watercraft; securities; insurance death benefit; safe deposit box; digital asset” (Ind. Code § 29-1-8-1).
